Terms of Service


Please read carefully the following provisions of this TERMS OF USE ("TERMS OF USE"). This is a legal agreement between you and "Citas" and its various & next versions (All Citass are "Citas") regarding the use of the Citas software programs and related documentation being installed by you on your device (the "Software"). By downloading the Software and/or using any of the services enabled by the Software (the "Services"), YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THE FOLLOWING TERMS AND CONDITIONS (INCLUDING ANY ADDITIONAL GUIDELINES AND FUTURE MODIFICATIONS) AND BY Citas’S PRIVACY POLICY, WHICH IS INCORPORATED HEREIN BY REFERENCE AND CAN BE FOUND AT PRIVACY POLICY. IF AT ANY TIME YOU DO NOT AGREE TO THESE TERMS AND CONDITIONS OF USE, YOU MAY NOT USE THE SOFTWARE OR SERVICES AND MUST IMMEDIATELY TERMINATE YOUR USE OF THE SOFTWARE AND ALL SERVICES.

Acceptance of the Present Terms & Conditions

By registering or using Citas on the mobile application or website (collectively, the “Service”), you acknowledge that the use of the Service is subject to Citas’s Terms of Service (“TOS”) which you must accept in order to use our Service. Furthermore, the use of our Service means that you also agree to our Privacy Policy and our Guidelines.

Changes to the Terms

We amend these Terms from time to time. We may do this for a variety of reasons including to reflect changes in or requirements of the law, new features, or changes in business practices. The most recent version of this Agreement will be posted within the Citas app within Settings, and you should regularly check for the most recent version. The most recent version is the version that applies. If the changes include material changes that affect your rights or obligations, we will notify you in advance of the changes by reasonable means, which could include notification through the Citas app. If you continue to use the Service after the changes become effective, then you agree to the revised Agreement. You agree that this Agreement shall supersede any prior agreements (except as specifically stated herein), and shall govern your entire relationship with Citas, including but not limited to events, agreements, and conduct preceding your acceptance of this Agreement.

Who Can Use the Services

You must be at least 13 years of age to create an account on Citas and use the Service. If you are between the ages of 13 and 17, you are not allowed to create an account on Citas and use the Service without the permission of your legal representative.

If you are the legal representative of a minor Citas user and you want to contact us, send us a message here.

No one under 13 is allowed to create an account or use the Service.

By using the Service, you represent and warrant that:

1. You can form a binding contract with Citas.

2. You are not a person who is barred from receiving the Service under the laws of the United States or any other applicable jurisdiction.

3. You have never been convicted of or pled no contest to a felony, a sex crime, or any crime involving violence, and that you are not required to register as a sex offender with any state, federal or local sex offender registry.

4. You will comply with this Agreement and all applicable local, state, national, and international laws, rules, and regulations.

Accessin Citas and Account Security

We may withdraw or amend Citas, and any service or material we provide on Citas, in our sole discretion without notice. We will not be liable if for any reason any part of Citas is unavailable at any time or for any period. From time to time, we may restrict access to all or part of Citas to users, including registered users.

You are responsible for:

Making all arrangements necessary for you to have access to Citas.

Ensuring that all persons who access Citas through your Internet connection are aware of this agreement and comply with it.

To access Citas or some of the resources it offers, you may be asked to provide certain registration details or other information. It is a condition of your use of Citas that all the information you provide to us is complete. You acknowledge that all information you provide to register with Citas or otherwise, including through the use of any interactive features on Citas, is governed by our Privacy Policy, and you consent to all actions we take with respect to your information consistent with our Privacy Policy.

If you choose, or are provided with, a username, password, or any other piece of information as part of our security procedures, you must treat that information as confidential, and you must not disclose it to any other person or entity. You also acknowledge that your account is personal to you and will not provide any other person with access to Citas or portions of it using your username, password, or other security information. You will notify us immediately of any unauthorized access to or use of your username or password or any other breach of security. You also will ensure that you log out of your account at the end of each session. You should use particular caution when accessing your account from a public or shared computer so that others are not able to view or record your password or other personal information.

We have the right to disable any username, password, or other identifier, whether chosen by you or provided by us, at any time in our sole discretion for any or no reason, including if, in our opinion, you have violated any provision of this agreement.

Intellectual-Property Rights

Citas and its entire contents, features, and functionality (including all information, software, text, displays, images, and audio, and the design, selection, and arrangement of it) are owned by the Company, its licensors, or other providers of that material and are protected by copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

This agreement permits you to use Citas for your personal, noncommercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on Citas, except as follows:

Your computer may temporarily store copies of those materials in RAM incidental to your accessing and viewing those materials.

You may store files that are automatically cached by your Web browser for display enhancement purposes.

You may print or download one copy of a reasonable number of pages of the Website for your own personal, noncommercial use and not for further reproduction, publication, or distribution.

You may download a single copy of the Citas mobile application to your mobile device solely for your own personal, noncommercial use, on condition that you agree to be bound by our end user license agreement for those applications.

If we provide social media features with certain content, you may take those actions as are enabled by those features.

You must not:

Modify copies of any materials from Citas.

Use any illustrations, photographs, or audio sequences, or any graphics separately from the accompanying text.

Delete or alter any copyright, trademark, or other proprietary rights notices from copies of materials from Citas.

You must not access or use for any commercial purposes any part of Citas or any services or materials available through Citas.

If you print, copy, modify, download, or otherwise use or provide any other person with access to any part of Citas in breach of this agreement, your right to use Citas will end immediately and you must, at our option, return or destroy any copies of the materials you have made. No interest in or to Citas or any content on Citas is transferred to you, and all rights not expressly granted are reserved by the Company. Any use of Citas not expressly permitted by this agreement is a breach of this agreement and may violate copyright, trademark, and other laws.

Trademarks

The Company name, the term Citas, the Company logo, and all related names, logos, product and service names, designs, and slogans are service marks and trademarks of the Company or its affiliates or licensors. You must not use those marks without the Company’s written permission. All other names, logos, product and service names, designs, and slogans on Citas are the service marks and trademarks of their respective owners.

Rules of Conduct

Safety of our users is of utmost importance for us. As a result, we have laid out the following Rules of Conduct which every user is subject to, whether they have an account or not. You are solely responsible for everything you write, post, upload, or make public. Furthermore, by using our Service, you also agree to our Guidelines.

If you are using our Services, you are not allowed to send, upload, or post anything which:

1. Could potentially cause any harm or damage to anyone

2. Is mean, is bullying someone or is intended to harass, scare or upset anyone

3. Is deliberately designed to provoke or antagonize people, especially trolling

4. Uses rude or profane language

5. Encourages dangerous or illegal activities

6. Encourages any type of self-harm

7. Contains any obscene or pornographic content

8. Contains any threat of any kind, including threats to yourself or others

9. Is racist or discriminates based on someone’s race, religion, age, gender, disability, or sexuality

10. Infringes on individual's privacy rights

11. Competes with our Service or is spam

12. Is illegal, could expose Citas to legal liability, or encourages people to get involved in anything which is illegal (for example, drugs, violence, or crime)

13. Is defamatory or violates any third party’s rights, including breach of confidence, copyright, trademark, patent, trade secret, moral right, privacy right, right of publicity, or any other intellectual property right.

14. Collects user content or information, or otherwise accesses the Services using automated means (such as harvesting bots, robots, spiders, or scrapers) without our prior permission

15. Violates any robot exclusion headers of the site, if any, or bypasses or circumvents other measures employed to prevent or limit access to Services

16. Shares, recompiles, decompiles, disassembles, reverse engineers, or makes or distributes any other form of, or any derivative work from, the Service

17. Attempts to scrape or collect any personal or private information from other users or from the Service

18. Pretends to come from someone other than you, or where you are impersonating someone else

19. Intercepts or monitors, damages, or modifies any communication not intended for you

20. Otherwise breaches the Terms of Service

Citas does not tolerate ANY objectionable content or abusive users. Any objectionable content posted on Citas will be reviewed by our Content Safety team. We reserve the right to take down any objectionable content immediately without any notice.

If you have received or are aware of any objectionable content on Citas, please do not hesitate to contact us at developer@xianwow.fun. You can also report any user or content within the Citas app. We will respond to all reports within 24 hours or less.

Content Standards

These content standards apply to all User Contributions and use of Interactive Services. User Contributions must in their entirety comply with all applicable federal, state, national, local, and international laws and regulations. User Contributions must not:

1. Contain any material which is defamatory, obscene, indecent, abusive, offensive, harassing, violent, hateful, inflammatory, or otherwise objectionable.

2. Promote sexually explicit or pornographic material, violence, or discrimination based on race, sex, religion, nationality, disability, sexual orientation, or age.

3. Infringe any patent, trademark, trade secret, copyright, or other intellectual property or other rights of any other person.

4. Violate the legal rights (including the rights of publicity and privacy) of others or contain any material that could give rise to any civil or criminal liability under applicable laws or regulations or that otherwise may be in conflict with this agreement and our Privacy Policy.

5. Be likely to deceive any person.

6. Promote any illegal activity, or advocate, promote, or assist any unlawful act.

7. Cause annoyance, inconvenience, or needless anxiety or be likely to upset, embarrass, alarm, or annoy any other person.

8. Impersonate any person, or misrepresent your identity or affiliation with any person or organization.

9. Involve commercial activities or sales, such as contests, sweepstakes, and other sales promotions, barter, or advertising.

10. Give the impression that they emanate from or are endorsed by us or any other person or entity, if this is not the case.

Privacy

Your privacy matters to us. You can learn how we handle your information when you use our Service by reading our Privacy Policy. We encourage you to give the Privacy Policy a careful look because, by using our Service, you agree that Citas can collect, use, and share your information consistent with that policy.

Please note that Citas may ask for permission to collect and store on our servers your personal information such as Contacts on your phone. We cannot and do not collect information unless you give us explicit permission to do so. While we collect information (such as your Contacts) to help you take full advantage of our product features, we understand if you feel uncomfortable giving us permission. If so, you are encouraged to deny giving us permission. You also have the ability to delete any information you have given us from our servers; for example, if you have given us permission to your Contacts, but no longer wish to have them stored in our servers, let us know at developer@xianwow.fun. You can also delete your account or any other information from our servers by reaching us at that email. To understand more on how Citas collects, uses, shares, and stores your information, please read our Privacy Policy.

Purchases

Generally. From time to time, Citas may offer products and services for purchase (“in app purchases”) through iTunes, Google Play, Citas direct billing or other payment platforms authorized by Citas. If you choose to make an in app purchase, you will be prompted to confirm your purchase with the applicable payment provider, and your method of payment (be it your card or a third party account such as Google Play or iTunes) (your “Payment Method”) will be charged at the prices displayed to you for the service(s) you’ve selected as well as any sales or similar taxes that may be imposed on your payments, and you authorize Citas or the third party account, as applicable, to charge you.

Auto_Renewal. Auto-Renewal. If you purchase an auto-recurring periodic subscription, your Payment Method will continue to be billed for the subscription until you cancel. After your initial subscription commitment period, and again after any subsequent subscription period, your subscription will automatically continue for an additional equivalent period, at the price you agreed to when subscribing. If you do not wish your subscription to renew automatically, or if you want to change or terminate your subscription, you will need to log in to your third party account and follow instructions to cancel your subscription, even if you have otherwise deleted your account with us or if you have deleted the Citas application from your device. Deleting your account on Citas or deleting the Citas application from your device does not cancel your subscription; Citas will retain all funds charged to your Payment Method until you cancel your subscription on Citas or the third party account, as applicable. If you cancel your subscription, you may use your subscription until the end of your then-current subscription term, and your subscription will not be renewed after your then-current term expires.

Virtual Items. From time to time, you may be able to purchase, a limited, personal, non-transferable, non-sublicensable, revocable license to use “virtual items,” such as gems (collectively, “Virtual Items”). Any Virtual Item balance shown in your account does not constitute a real-world balance or reflect any stored value, but instead constitutes a measurement of the extent of your license. Virtual Items do not incur fees for non-use, however, the license granted to you in Virtual Items will terminate in accordance with the terms of this Agreement, when Citas ceases providing the Service or your account is otherwise closed or terminated. Citas, in its sole discretion, reserves the right to charge fees for the right to access or use Virtual Items and/ or may distribute Virtual Items with or without charge. Citas may manage, regulate, control, modify or eliminate Virtual Items at any time. Citas shall have no liability to you or any third party in the event that Citas exercises any such rights. Virtual Items may only be redeemed through the Service. ALL PURCHASES AND REDEMPTIONS OF VIRTUAL ITEMS MADE THROUGH THE SERVICE ARE FINAL AND NON-REFUNDABLE. The provision of Virtual Items for use in the Service is a service that commences immediately upon the acceptance of your purchase of such Virtual Items. YOU ACKNOWLEDGE THAT Citas IS NOT REQUIRED TO PROVIDE A REFUND FOR ANY REASON, AND THAT YOU WILL NOT RECEIVE MONEY OR OTHER COMPENSATION FOR UNUSED VIRTUAL ITEMS WHEN AN ACCOUNT IS CLOSED, WHETHER SUCH CLOSURE WAS VOLUNTARY OR INVOLUNTARY.

Refunds. Generally, all charges for purchases are nonrefundable, and there are no refunds or credits for partially used periods. We may make an exception if the laws applicable in your jurisdiction provide for refunds

For subscribers residing in Arizona, California, Connecticut, Illinois, Iowa, Minnesota, New York, North Carolina, Ohio and Wisconsin, the terms below apply:

You may cancel your subscription, without penalty or obligation, at any time prior to midnight of the third business day following the date you subscribed. In the event that you die before the end of your subscription period, your estate shall be entitled to a refund of that portion of any payment you had made for your subscription which is allocable to the period after your death. In the event that you become disabled (such that you are unable to use the services of Citas) before the end of your subscription period, you shall be entitled to a refund of that portion of any payment you had made for your subscription which is allocable to the period after your disability by providing the company notice in the same manner as you request a refund as described below.

To request a refund:

If you subscribed using your Apple ID, refunds are handled by Apple, not Citas. To request a refund, go to iTunes, click on your Apple ID, select “Purchase history,” find the transaction and hit “Report Problem”. You can also submit a request at https://getsupport.apple.com.

If you subscribed using your Google Play Store account or through Citas directly: please contact customer support at developer@xianwow.fun with your order number for the Google Play Store (you can find the order number by logging in to Google Wallet). Please also include the first name and telephone number associated with your account along with your order number.

Warranty Disclaimers

You understand that we cannot and do not guarantee or warrant that files available for downloading from the Internet or Citas will be free of viruses or other destructive code. You are responsible for implementing sufficient procedures and checkpoints to satisfy your particular requirements for anti-virus protection and accuracy of data input and output, and for maintaining a means external to Citas for any reconstruction of any lost data. We will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses, or other technologically harmful material that may infect your computer equipment, computer programs, data, or other proprietary material due to your use of Citas or any services or items obtained through Citas or to your downloading of any material posted on it, or on any website linked to it.

Your use of Citas, its content, and any services or items obtained through Citas is at your own risk. Citas, its content, and any services or items obtained through Citas are provided “as is” and “as available,” without any warranties of any kind, either express or implied. Neither the Company nor any person associated with the Company is making any warranty or representation with respect to the completeness, security, reliability, quality, accuracy, or availability of Citas. Neither the Company nor anyone associated with the Company represents or warrants that Citas, its content, or any services or items obtained through Citas will be accurate, reliable, error-free, or uninterrupted, that defects will be corrected, that Citas or the server that makes it available are free of viruses or other harmful components, or that Citas or any services or items obtained through Citas will otherwise meet your needs or expectations.

The Company disclaims all warranties of any kind, whether express or implied, statutory or otherwise, including any warranties of merchantability, noninfringement, and fitness for particular purpose.

The foregoing does not affect any warranties that cannot be excluded or limited under applicable law.

Limitation on Liability

In no event will the Company, its affiliates, or their licensors, service providers, employees, agents, officers, or directors be liable for damages of any kind, under any legal theory, arising out of or in connection with your use, or inability to use, Citas, any content on Citas, or any services or items obtained through Citas, including any direct, indirect, special, incidental, consequential, or punitive damages, including personal injury, pain and suffering, emotional distress, loss of revenue, loss of profits, loss of business or anticipated savings, loss of use, loss of goodwill, loss of data, and whether caused by tort (including negligence), breach of contract, or otherwise, even if foreseeable.

To the fullest extent provided by law, in no event will the collective liability of the Company and its subsidiaries and affiliates, and their licensors, service providers, employees, agents, officers, and directors, to any party (regardless of the form of action, whether in contract, tort, or otherwise) exceed the greater of $250 or the amount you have paid to the Company for the applicable service in the last three months out of which liability arose.

The limitation of liability set out above does not apply to liability resulting from our gross negligence or willful misconduct or death or bodily injury caused by products you purchased through the site.

Modifying the Service and Termination

Citas is always striving to improve the Service and bring you additional functionality that you will find engaging and useful. This means we may add new product features or enhancements from time to time as well as remove some features, and if these actions do not materially affect your rights or obligations, we may not provide you with notice before taking them. We may even suspend the Service entirely, in which event we will notify you in advance unless extenuating circumstances, such as safety or security concerns, prevent us from doing so.

You may terminate your account at any time, for any reason, by contacting us and letting us know you’d like to terminate your account. However if you use a third party payment account, you will need to manage in app purchases through such account (e.g., iTunes, Google Play) to avoid additional billing.

We reserve the right to terminate your user account at any time, including if you have failed to comply with any of the provisions of these Terms, or if activities occur on your account which, in our sole discretion, would or might cause damage to or impair the Services or infringe or violate any third party rights, or violate any applicable laws or regulations. Upon such termination, you will not be entitled to any refund for purchases.

Entire Agreement; Other.

This Agreement, along with the Privacy Policy, the Safety Tips, Guidelines, and any terms disclosed to you if you purchase or have purchased additional features, products or services we offer on the Service, contains the entire agreement between you and Citas regarding your relationship with Citas and the use of the Service. If any provision of this Agreement is held invalid, the remainder of this Agreement shall continue in full force and effect. The failure of Citas to exercise or enforce any right or provision of this Agreement shall not constitute a waiver of such right or provision. You agree that your Citas account is non-transferable and all of your rights to your account and its Content terminate upon your death. No agency, partnership, joint venture, fiduciary or other special relationship or employment is created as a result of this Agreement and you may not make any representations on behalf of or bind Citas in any manner.
